
Your organization just rolled out AI-powered documentation tools in your EHR. Maybe it’s an ambient scribe that listens to sessions and generates notes. Maybe it’s a system that suggests treatment plan updates or flags coding opportunities. You didn’t ask for it, and nobody trained you on the compliance implications. But you’re the one documenting patient interactions, and you’re the one who’ll notice first when something goes wrong.
The February 2024 changes to 42 CFR Part 2 modernized how substance use disorder records can be shared for treatment, payment, and healthcare operations, which affects all systems (including AI) that access these records, but did not create AI-specific rules. Your leadership is responsible for vendor contracts and governance frameworks. Your role is different. You need to know what to watch for in your daily documentation, when AI behavior crosses into dangerous territory, and who to tell when you see something that doesn’t look right.
How to Recognize When AI Is Accessing Protected Records
The 2024 alignment of 42 CFR Part 2 with HIPAA changed how substance use disorder records can be shared, but it maintained special protections for SUD counseling notes (HHS, 2024). These are the notes where you document the actual conversation and analysis from counseling sessions. They require separate, specific patient consent before an AI system can process them (HHS, 2024).
Here’s what this means for your daily work. If you’re using an AI scribe during an SUD counseling session, that system needs explicit authorization to access your session notes. If you’re reviewing an AI-generated treatment plan and it references details from counseling sessions that you didn’t include in the general medical record, that’s a red flag. The AI shouldn’t have access to counseling notes unless the patient specifically consented to AI processing of those records.
You didn’t sign up to police your EHR’s AI, but you’re the one who’ll notice first when it accesses records it shouldn’t. Watch for these patterns: AI-generated summaries that include counseling session details you know weren’t in the progress notes. Treatment recommendations that reference trauma history or family dynamics that only appeared in your counseling documentation. Auto-populated assessment fields that pull from restricted notes without your input.
When you see this happening, document what you observed. Note the date, the patient record, and what information appeared where it shouldn’t. This isn’t about getting anyone in trouble. It’s about protecting your patients and protecting yourself professionally.
The Red Flags That Signal Data Quality Problems
Healthcare AI systems learn from the data they’re trained on, and they make recommendations based on the patient information they can access (FDA, 2022). The FDA emphasizes that healthcare professionals must be able to independently review the basis for AI recommendations and not rely primarily on those recommendations for clinical decisions (FDA, 2022). This means you need to be able to verify that AI suggestions make sense based on what you know about the patient.
If the AI is suggesting treatment changes based on information you can’t see in the patient’s accessible record, that’s a 42 CFR Part 2 red flag. The system might be accessing counseling notes or SUD treatment records that require special consent. Or it might be pulling from another patient’s record due to a data quality error. Either way, you need to verify the recommendation against the actual patient chart before acting on it.
Practical scenarios to watch for: An AI system suggests increasing medication dosage based on “recent reported symptoms” that don’t appear anywhere in the patient’s current visit notes. A risk assessment tool flags a patient for suicide risk based on factors that aren’t documented in their accessible treatment history. An automated treatment plan includes interventions for conditions the patient hasn’t been diagnosed with in your facility.
These patterns suggest the AI is either accessing restricted records without proper authorization or making recommendations based on corrupted or incomplete data. Both situations create professional liability for you if you act on the AI recommendation without verification. Your clinical judgment remains the final authority (FDA, 2022). If an AI suggestion doesn’t align with what you know about the patient from your direct clinical work, trust your professional assessment and investigate before proceeding.
Who to Tell When Something Seems Wrong
The American Medical Association’s governance framework establishes that clinical experts are the appropriate decision-makers for evaluating AI performance (AMA, 2024). That means your organization should have clear pathways for frontline staff to report concerns about AI behavior. If those pathways don’t exist yet, that’s information your leadership needs to hear.
Start with your direct supervisor or clinical director. Frame your concern in terms of patient safety and regulatory compliance. Use specific language: “I observed the AI system auto-populating treatment plan information that I couldn’t verify in the patient’s accessible record” is more actionable than “something seems off with the AI.”
If your supervisor isn’t responsive or if the behavior continues after you’ve reported it, escalate to your compliance officer or privacy officer. These roles exist specifically to handle regulatory concerns about patient information. Document your escalation attempts. Note who you spoke with, when, and what response you received.
Some organizations are implementing dedicated AI oversight committees as part of their governance structure (AMA, 2024). If your organization has one, that’s another appropriate escalation pathway. The regulatory transparency requirements for AI systems mean your organization needs mechanisms to monitor how these tools perform in real-world use (ONC, 2024). Your frontline observations are essential data for that monitoring.
Protect yourself by documenting your concerns and your escalation attempts in writing. If you observe AI accessing restricted records or making recommendations based on information that shouldn’t be available, send an email to your supervisor documenting what you saw. Keep a copy. If the situation involves a specific patient interaction where you chose not to follow an AI recommendation because it didn’t align with your clinical judgment, document that decision in the patient’s chart.
Your professional license depends on your clinical decision-making, not on what an AI system suggests. Regulatory frameworks are clear that AI should inform but not replace clinical judgment (FDA, 2022). If you’re being pressured to follow AI recommendations that don’t align with your professional assessment of patient needs, that’s a conversation for your clinical leadership and potentially your licensing board.
The complexity of AI compliance isn’t your fault, and the responsibility for proper implementation sits with your organization’s leadership. But you’re the first line of defense for patient privacy and care quality.
